If South Sutter is allowed to move forward with the project, the district could declare eminent domain over land to be flooded, said Bear Yuba Land Trust Vice President and Garden Bar Preserve Manager Joe Byrne.
It was unclear what legal challenges could be made to the taking of land placed in conservation easements, added Byrne, who has a background as a real estate lawyer and developer.
But the land trust already is fighting the project.
The website created by proponents to present information about Garden Bar (www. GardenBarWater.com) casts the proposed reservoir in the context of water supply reliability statewide.
“California is in critical need of additional reservoirs to meet water supply needs for urban, rural, agricultural and environmental uses,” it states on the home page.
Land trust Executive Director Marty Coleman-Hunt views the campaign as one based on fear and prejudice.
“It describes the area to be flooded as a wasteland, a rocky canyon area that’s not inhabited,” Coleman-Hunt said.
It gives a sense of, Coleman-Hunt said, “Don’t worry about those Nevada County people; this is a wasteland. (Water supply) is a problem for the whole state.
