When Feliciano Mendez of Vista got a letter from Bank of America saying his loan modification had been approved, he happily began making payments. A decline in his trucking business had forced him into default.

“I begged the bank to work with me and they gave me a loan modification that looked good, so I signed it and sent it back to them,” he said.

At one point, Bank of America sent him a second loan document, which looked just the same. He says his loan officer assured him that it was just a duplicate and he didn’t need to sign it if he had already signed the first set.

For the next nine months, Mendez paid the modified amount with a money order, as the bank had requested. When he called in May, asking whether he could start paying with personal checks instead of money orders, he says the bank told him it decided to foreclose and had already posted a sale date of June 10.

Mendez said he was shocked when he was learned of the bank’s decision – “I mean, this is the house where we raised our kids” – but his wife took it even harder.
